Բելգիայի Դաշնային խորհրդարանում կրկին բարձրացվել է Ավետիք Չալաբյանի քաղաքական հետապնդման հարցը

Բելգիայի Դաշնային խորհրդարանի պատգամավոր Էլլեն Սամինը (Vlaams Belang – Ֆլամանդական շահ կուսակցություն) կրկին հարց է ուղղել փոխվարչապետ և արտաքին գործերի նախարար Մաքսիմ Պրևոյին՝ անդրադառնալով հայ ընդդիմադիր գործիչ, «Հայաքվե» ազգային քաղաքացիական միավորման համակարգող Ավետիք Չալաբյանի կալանավորմանը։

Պատգամավոր Սամինը հիշեցրել է, որ Ավետիք Չալաբյանի նախորդ քրեական հետապնդումը քննադատության է արժանացել միջազգային կառույցների կողմից՝ նշելով ԱՄՆ դեսպանության Մարդու իրավունքների զեկույցը, Եվրոպայի խորհրդի խորհրդարանական վեհաժողովի և Freedom House-ի գնահատականները։ Նա նաև հարցրել է, թե ինչպես է Եվրոպական միությունը կարողանում համադրել Հայաստանի հետ համագործակցությունը` քաղաքական ընդդիմության, հիմնարար ազատությունների և դատական իշխանության անկախության վերաբերյալ օրեցօր աճող հետապնդումներին զուգահեռ:

Ի պատասխան՝ նախարար Մաքսիմ Պրևոն վերահաստատել է, որ Բելգիան և Եվրոպական միությունը շարունակաբար հետևում են Հայաստանում իրավունքի գերակայության, մարդու իրավունքների և դատական իշխանության անկախության պահպանմանը, և որ այդ հարցերը մշտապես ընդգրկված են Հայաստան–ԵՄ երկխոսության օրակարգում։

Իր եզրափակիչ խոսքում պատգամավոր Էլլեն Սամինն ընդգծել է, որ Հայաստանի հետ ավելի սերտ գործընկերությունը պետք է անպայմանորեն ուղեկցվի իրավունքի գերակայության, քաղաքական բազմակարծության, ընդդիմության իրավունքների պաշտպանության և հիմնարար ազատությունների նկատմամբ հետևողական ուշադրությամբ, քանի որ դա բխում է հենց Հայաստանի ժողովրդավարության ամրացման շահերից։

21.01 Ellen Samyn (Vlaams Belang) I refer to the written version of my question.

Today, Armenian opposition figure Avetik Chalabyan was once again arrested by the Armenian authorities. Chalabyan, co-founder of the National Agenda Party and a vocal advocate for the rights of the Armenians of Artsakh, has in recent years been actively involved in several civic initiatives opposing the Armenian government’s policies regarding Artsakh, relations with Azerbaijan, and the future of the Armenian diaspora.

The precise reasons for this latest arrest are not yet fully clear. Nevertheless, the case raises serious questions in light of the previous criminal proceedings against Mr. Chalabyan, which attracted international attention over the past years and prompted comments from several human rights organizations and international institutions regarding the application of the relevant criminal provisions and the safeguards for fundamental freedoms and the rule of law.

For example, the United States Embassy in Armenia, in its Human Rights Report, referred to the case as an example of a possible arbitrary arrest. Likewise, the Parliamentary Assembly of the Council of Europe (PACE) expressed concern regarding the criminalization of encouraging participation in public demonstrations, describing the application of the relevant legal provision as troubling. Freedom House, for its part, criticized the restriction imposed on Mr. Chalabyan prohibiting him from participating in public assemblies for a certain period.

Is Belgium monitoring the case of Avetik Chalabyan through its diplomatic representation in Armenia or through the European institutions?

During your recent bilateral contacts with Armenia, have you raised concerns regarding the protection of political freedoms, the rights of opposition figures, and the independence of the judiciary?

How does the European Union reconcile its growing cooperation with Armenia with the concerns expressed by various international organizations regarding the treatment of opposition figures and critical voices?

Will you advocate within the European Union for continued attention to fundamental freedoms, political pluralism, and an independent judiciary in Armenia?

21.02 Deputy Prime Minister and Minister Maxime Prévot

Against the backdrop of Armenia’s parliamentary elections of 7 June, allegations have been brought against Mr. Chalabyan. However, it is not for Belgium to comment on an individual judicial proceeding that falls within the jurisdiction of the Armenian authorities.

Through its Embassy in Yerevan, and in close coordination with the European Union, Belgium continues to monitor respect for the rule of law, human rights, and the independence of the judiciary. These fundamental principles were also addressed in the dialogue with the Armenian authorities in the period leading up to the elections. Human rights and fundamental freedoms remain a permanent component of the dialogue between Belgium and Armenia. These issues are regularly discussed during bilateral contacts with the Armenian authorities.

The enhanced cooperation between the European Union and Armenia reflects a shared commitment to closer relations and mutually beneficial cooperation. Both the European Union and Armenia have an interest in promoting stability, prosperity, and resilience in the South Caucasus.

This cooperation also provides an opportunity for an open and constructive dialogue on issues of common concern, including the rule of law, human rights, and fundamental freedoms. Belgium also encourages, within the framework of the European Union, Armenia’s continued efforts to pursue reforms in these areas.

Enhanced cooperation and an open, critical dialogue are complementary and should go hand in hand.
